Briefly Medical — Engagement agreement & terms
1. Who this covers
[DRAFT — pending attorney review] This agreement is between Briefly Medical ("we," "us") and the law firm or attorney ("you," "the firm") that creates an account to use Briefly Medical's case-review tools. It applies once you accept it during sign-up or onboarding, and continues until either side ends it in writing.
2. What Briefly Medical does
[DRAFT — pending attorney review] We organize and help you review medical records for a case you are handling: uploading records, sorting and indexing them, preparing reports, and supporting expert review. We are a tool and a service that assists your review — not a law firm, and not a substitute for your own professional judgment or your retained experts' opinions.
3. Automated reading and analysis
[DRAFT — pending attorney review]
BrieflyMedical uses automated tools, including optical character recognition, page reading and analysis software, to read, organize and analyze medical records. Like all mechanical and automated tools, these can make mistakes, including misreading, omitting or misattributing information. For that reason, BrieflyMedical applies human verification against the original record pages to findings it presents as verified, and clearly labels any work that has not been verified as preliminary. No review of medical records, whether by a person or by automated tools, can guarantee that every relevant fact will be identified; BrieflyMedical is designed to make review more complete and verifiable, not to guarantee completeness. Our work is intended to assist, not replace, professional judgment. Any finding, citation or conclusion that will be relied on in a legal proceeding should be confirmed against the original records and is subject to the professional standards and due diligence that apply to the attorney and any retained expert. Preliminary or unverified results should not be relied on without such confirmation.
4. Confidentiality and protected health information
[DRAFT — pending attorney review] Case records you upload may contain protected health information. We keep records only for the cases you grant us, do not share them outside the people you authorize for that case, and will enter into a Business Associate Agreement before any protected health information is shared on a real, non-practice case. Until that BAA is in place, you will not be given access to protected health information on a real case through this platform.
5. Fees
[DRAFT — pending attorney review] Fees for using Briefly Medical on a specific case are agreed with you separately and are not set by this page. ____________________
6. Limits of our role
- [DRAFT — pending attorney review] We do not give legal advice and do not represent you or your client in any proceeding.
- We do not give a final medical opinion; any clinical opinion is given by a qualified reviewing physician or retained expert, and is labeled as preliminary until confirmed.
- You remain responsible for deciding what to file, argue or rely on, and for your own professional and ethical obligations.
7. Ending this agreement
[DRAFT — pending attorney review] Either side may end this agreement in writing. Case records already uploaded are retained or returned as agreed separately for that case.
8. Accepting these terms
[DRAFT — pending attorney review] When you accept these terms during sign-up, we record that acceptance (your account, the date and time, and which version of this page you accepted) so there is a clear record of what was agreed and when. You can ask us for a copy of your acceptance record at any time.
